Property of a New York Collector Jay, John Manuscript document signed ("John Jay") as Governor of New York, commissioning Richard Varick as Mayor of New York City Broadside on vellum (242 x 394 mm), written in a neat clerical hand, Albany, 4 March 1797, endorsed on the verso "Commission to Richard Varick Esquire, as Mayor of the City of New York," further endorsed by Jasper Hopper, Deputy Secretary of State of New York, "Passed the Secretary's Office the 8th day of March 1797—at the 9th line word perquisites interlined," and attested by Robert Benson, Clerk of the City of New York, accompanied its original embossed-paper and wax pendant seal, now detached from its ribbons; light foxing. "The People of the State of New York, by the grace of God, free and independent To all to whom these presents shall come or may concern, greeting, Know ye, that we reposing especial trust and confidence in the loyalty, integrity and prudence of Richard Varick, Esquire, have therefore of our especial grace, certain knowledge and meer motion, nominated, constituted and appointed, and by these presents Do nominate, constitute and appoint the said Richard Varick to be Mayor of our City of New York, Water Bailiff, and Clerk of the Market of our said City, … from the day of the date hereof, for and during the term of one year. …" Governor Richard Nicolls appointed Thomas Willett as the first English "mayor of New York" in 1665. Starting in 1777, the mayor was appointed by the Council of Appointments, in which the state's governor had the loudest voice. In 1821, the Common Council, which included elected members, gained the authority to choose the mayor. An amendment to the New York State constitution in 1834 provided for the direct popular election of the mayor. Richard Varick—who served with distinction during the American Revolution—was appointed Mayor of New York City for eleven terms, from 1789 to 1801. During this period, the population of the city doubled, making basic civic necessities like water and disease control the focus of his attentions. Due to his support of the unpopular Jay's Treaty (between the US and Great Britain) in 1794, he was almost driven out of City Hall by a riot, while Hamilton was challenged to a duel by Edward Livingston. In a sweep of political fortunes that made Thomas Jefferson president, Varick was replaced in 1801 by Livingston. [England (perhaps London), late 14th or early 15th century] i+4+ii+152 leaves, c.195×140mm, paginated in modern pencil ignoring the preliminaries and omitting 2 leaves after p.75, two after p.185, and jumping from 266 to 277, repeating 277, and then jumping to 288, thus reaching ‘319’ by the end, most missing leaves replaced by unnumbered blank paper leaves, lacking at least two original leaves before p.1 and single leaves after pp.20, 58, 68, 74, 96, 108, 166, 182, 252, and 260, two leaves after pp.82 and 230, at least two after p.162, and four after p.88, collation: 14, 28-2 (1st & 2nd leaves missing), 38-1 (5th missing), 4–58, 68-2 (1st and 7th missing), 78-1 (3rd missing), 88-5 (1st, 2nd, and 6th–8th missing), 98-2 (1st and 6th missing), 108-1 (5th missing), 11–138, 148-6? (2) The preliminary tables were presumably added within a year of 1438, as they commenced with that year. (3) In the early 16th century Thomas Robards formally registered his ownership of the volume, before witnesses, and inscribed it ‘This is Thomas Robards booke, Witnes by me John Benfylld and Jone Russell and Walter Crays and John Hayward the baylay [i.e. bailiff] finis’ (f.iir). (4) At the Reformation references to Thomas Becket were effaced. (5) Unidentified owner: a clipping from an auction or dealer catalogue describes a ‘Lectionarium et sequentiæ cum antiphonario et orationibus pro festibus ecclesiæ Romanæ […] by an Italian scribe […]’ (front pastedown). (6) Rev. Nathaniel Castleton Stephen Poyntz (1846–1920): inscribed ‘E Libris Nath. C.S. Poyntz’ (front pastedown); his sale at Sotheby’s, 28 June 1921, lot 595. Leipzig: Nikolaus Wolrab, 1545 Luther’s Kirchen Postilla are sermons for the Sunday epistle and gospel passage, from Easter through the 26th Sunday after Advent (“Sommerteil”). They are not sermons from Luther’s own pen, but collations made by Stephan Roth of notes taken by listeners in Wittenberg, originally published without Luther’s participation or permission in 1526, here revised (with Luther’s approval) by Kaspar Creutziger (Cruciger), and dedicated to Georg III von Anhalt-Plötzkau, at Wittenberg, 25 December 1544. In 1545, Nikolaus Wolrab reprinted at Leipzig Roths Festpostille, his compilation of gospel periscopes on the saints’ and festival days for the entire year, in two parts (winter and summer). Bound-in here is the summer volume. This exceptional binding is a fine example of the diffusion of Italian Renaissance bookbinding styles, in this case from Bologna to Dresden. The binder, Jakob Weidlich settled in Dresden sometime before 1550, found work at the kursächsischen Hof (but without appointment as Hofbuchbinder), and in 1564 cofounded the local bookbinders’ guild (Einbanddatenbank, workshop w003975). According to Ilse Schunke, Weidlich was a binder “adaptable and receptive to everything new” (Leben und Werk Jakob Krauses, p. 62). He studied bindings brought back from Padua by Georg Fabricius, Rektor der Fürstenschule St. Afra in Meißen, and from Bologna, by Nikolas von Ebeleben, Domherr in Meißen, and soon mastered binding “auf welsche Manier.” Two bindings now in Weimar executed by Weidlich ca. 1549–1550 might be Nikolas von Ebeleben’s first commissions. About 1553, Nikolas commissioned Weidlich to bind Luther’s works in German. Eight (of twelve) volumes of this set have survived: five in red goatskin bindings by Weidlich, these imitating Bolognese styles, and three in brown goatskin bindings by Thomas Stelbogen of Leipzig, in German style. Altogether, eleven bindings by Weidlich for Nikolas are known (Einband Forschung 18 (2006), pp. 25–33; 19 (2006), pp. 26–37). One of the volumes of Luther he bound for Nikolas will be offered in a future Bibliotheca Brookeriana sale. The owner of the present volume, Georg (Jörg) von Ebeleben (ca. 1500–1554), was Nikolas’s brother. Five volumes from a Wittenberg edition of Luther’s works (published 1550–1552) are said to be bound similarly, in red goatskin, with “Iorge Von Ebeleben” and date 1552 lettered on the lower covers (Foot, Henry Davis Gift, 1, p. 276). Either this set was a gift from Nikolas to Georg, or Georg commissioned Weidlich to copy bindings he admired in Nikolas’s library. Another brother, Hans (ca. 1500–1569), was late to the party: his set of Luther’s works in German was bound in 1560 by Stelbogen (Foot, p. 277). Nikolas and Georg and Hans were three of seven sons of Apel von Ebeleben (ca. 1460–1528) and Agnes von Löser. Unlike Nikolas, who matriculated at six universities (the last Ferrara, in 1546), and married late (1555), Georg skipped university, and ca. 1530 married Margarethe Zenger von Thanstein. After the death of her father, they came into possession of Hofmark Thanstein, and it remained an Ebeleben seat for one hundred years. Georg entered the service of the Schwarzburg-Leutenberg, became a councillor (fürstlicher Rat und Hofmeister) in Neumarkt, later a Palatine bailiff (pfalzgräflicher Amtmann) in Waldmünchen. In 1552, he was in the entourage of Kurfürst Friedrich II von der Pfalz; in 1553, he was appointed Hofmeister of Neunburg. Georg died 5 December 1554 and was interred in Dorfkirche Thanstein (epitaph in the vestibule). Shortly after his death this book seems to have left the possession of his family. Weidlich’s binding for Georg is not an exact copy of those he executed on Luther’s works for Nikolas. Georg’s volume has five raised bands on the back, whereas Nikolas’s uniformly have four; the geometric bandwork on Georg’s binding is painted black, and the covers on Georg’s binding are closed by clasps (stamped “PB”). Such differences led Jutta Fliege to suggest that our volume might perhaps have emanated from a different shop (Einband Forschung 4, p. 52). Folio (315 x 203 mm).
