CONDITIONS OF SALE
The following Conditions of Sale and GA Authenticity and Returns Policy are Sotheby’s, Inc. (“Sotheby’s”), Goldin Auctions, LLC (“GA”) and the Consignor’s entire agreement with the purchaser and any bidders relative to the property listed in this catalogue. Sotheby’s and GA are referred to herein collectively as “we,” “us,” and “our.”
The Conditions of Sale, GA Authenticity and Returns Policy, the glossary, if any, and all other contents of this catalogue are subject to amendment by Sotheby’s by the posting of such amendments on the Sotheby's website (www.sothebys.com). The property will be offered by GA, as agent for the Consignor, unless the catalogue indicates otherwise.
By participating in any sale, you acknowledge that you are bound by these Conditions of Sale and GA Authenticity and Returns Policy.
1. As Is Goods auctioned are often of some age. Subject to the GA Authenticity and Returns Policy, all property is sold “AS IS” without any representations or warranties by us or the Consignor as to merchantability, fitness for a particular purpose, the correctness of the catalogue or other images or descriptions of the physical condition, size, quality, grading, rarity, importance, medium, frame, provenance, exhibitions, literature or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. We and the Consignor make no representations and warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. We and the Consignor are not responsible for errors and omissions in the catalogue, glossary, or any supplemental material. If there is an error in description that a winning bidder believes has occurred, they must contact GA within 14 days of receiving the property to discuss such purported error. If GA is contacted after 14 days, even in the event of a description error, the bidder shall have no recourse. GA will handle these cases in a case by case basis at its sole discretion. We will not be responsible or liable for damage to frames and glass coverings, regardless of the cause.
2. Inspection Prospective bidders should make themselves aware of the property on which they wish to bid, which may include information about its condition and size and whether or not the property has been repaired or restored. Please contact GA regarding inspection or for additional information. Any images and condition reports are provided to assist you with assessing the condition of the property and are for guidance only. All measurements given in the descriptions are approximate.
3. Buyer’s Premium; Overhead Premium A buyer’s premium and an overhead premium will be added to the hammer price and are payable by the purchaser as part of the total purchase price. The buyer’s premium is 25% of the hammer price up to and including $400,000, 20% of any amount in excess of $400,000 up to and including $4,000,000, and 13.9% of any amount in excess of $4,000,000. The overhead premium is 1% of the hammer price.
4. Withdrawal We reserve the right to withdraw any property before, during and after the sale and shall have no liability whatsoever for such withdrawal.
5. Per Lot Unless otherwise stated, all bids are per lot as numbered in the catalogue.
6. Bidding When you click on ‘Place a Bid’ on a lot, you will be prompted to either log in to your Sotheby’s account, or to create a Sotheby's account if you do not already have one. Once you have either created an account or logged into your account, you will be presented with the Conditions of Sale for the auction in which that lot is offered. Once you have accepted the Conditions of Sale, you may proceed with placing a bid on that lot or any other lot in that auction. All bids placed in that auction are governed by the Conditions of Sale for that auction.
You may bid at or above the starting bid displayed on the online platform. You may also input a maximum bid which, upon confirmation, will be executed automatically up to this predefined maximum value in response to other bids, including bids placed by GA or Sotheby’s on behalf of the seller, up to the amount of the reserve (if applicable). Bids placed by GA or Sotheby’s on behalf of the seller, up to the amount of the reserve, will be counted toward the total bid count displayed on the online platform. The current leading bid will be visible to all bidders; the value and status of your maximum bid will be visible only to you, unless it is the leading bid. If the status of your bid changes, you will receive notifications via email and push (if you have the Sotheby’s App installed).
As soon as you place and confirm your bid amount, your bid is submitted. You accept and agree that bids submitted by you are final. Sotheby's, GA and the Consignor are not responsible for any errors in bidding. We reserve the right to reject any bid. The highest bidder acknowledged by the Sotheby's online bidding system will be the purchaser. Sotheby’s has absolute and sole discretion in the case of error or dispute with respect to bidding, and whether during or after the sale, to determine the successful bidder, to re-open the bidding, to cancel the sale or to re-offer and re-sell the item in dispute. If any dispute arises after the sale, our sale record is conclusive.
By participating in the sale, you represent and warrant that any bids placed by you, or on your behalf, are not the product of any collusive or other anti-competitive agreement and are otherwise consistent with federal and state antitrust law.
By participating in the sale, you represent and warrant that:
(a) The bidder and/or purchaser is not subject to trade sanctions, embargoes or any other restriction on trade in the jurisdiction in which it does business as well as under the laws of the European Union, the laws of England and Wales, or the laws and regulations of the United States, and is not owned (nor partly owned) or controlled by such sanctioned person(s) (collectively, “Sanctioned Person(s)”);
(b) Where acting as agent (with Sotheby’s prior written consent), the principal is not a Sanctioned Person(s) nor owned (or partly owned) or controlled by Sanctioned Person(s); and
(c) The bidder and/or purchaser undertakes that none of the purchase price will be funded by any Sanctioned Person(s), nor will any party be involved in the transaction including financial institutions, freight forwarders or other forwarding agents or any other party be a Sanctioned Person(s) nor owned (or partly owned) or controlled by a Sanctioned Person(s), unless such activity is authorized in writing by the government authority having jurisdiction over the transaction or in applicable law or regulation.
Sotheby's reserves the right, in our sole discretion, to refuse your participation in the auction or to revoke your permission to participate before, during or after the sale. Bidders should also consult the Sotheby's Website for the most up to date cataloguing of the property in this catalogue. Bidders are responsible for making themselves aware of all available notices, which will be posted online.
7. Closing Bidding Bids may be submitted from the start of the auction until bidding on the specific lot closes. An end time will be displayed for each lot on the lot detail page. Lots will close in one minute increments unless a bid is placed within one (1) minute of a lot's scheduled end time, in which case we will extend the sale of that lot by two (2) minutes from the time of the last bid. The extension of any one lot's closing time does not affect any other lot's closing time; therefore, it is possible that lots will close out of numerical lot order. Upon the closing of each lot, you will receive another email and push notification indicating whether you have won or lost each lot on which you have placed a bid.
8. Cancelling Bids A bidder may cancel a bid placed in an online-only sale only if either (a) the description of the lot or the condition report for the lot listed in the catalogue has been materially revised after the bid was placed or (b) a notice regarding the lot has been posted on Sotheby’s website after the bid was placed. For further information, please contact the Sotheby’s Bids Department in New York at bids.newyork@sothebys.com.
9. Record of Sale The record of sale kept by Sotheby's will be taken as absolute and final in all disputes. In the event of a discrepancy between any online records or messages provided to you and the record of sale kept by Sotheby's, the record of sale will govern.
Successful bidders will be notified and invoiced by Sotheby's after the sale. In the event of any discrepancy between any online purchase information and the invoice sent to you by Sotheby's following the sale, the invoice prevails. Successful bidders will be separately invoiced by GA for any shipping charges in accordance with the terms of these Conditions of Sale.
10. Purchaser’s Responsibility At the close of a lot, the contract between the consignor and the purchaser is concluded, and the winning bidder thereupon will immediately pay the full purchase price or such part as we or GA may require. Title in a purchased lot will not pass until Sotheby’s has received the full purchase price in cleared funds. The purchaser’s obligation to immediately pay the full purchase price or such part as we may require is absolute and unconditional and is not subject to any defenses, setoffs or counterclaims of any kind whatsoever. GA is not obligated to release a lot to the purchaser until title to the lot has passed and any earlier release does not affect the passing of title or the purchaser’s unconditional obligation to pay the full purchase price. In addition to other remedies available to us by law, we reserve the right to impose from the date of sale a late charge of the annual percentage rate of Prime + 6% of the total purchase price if payment is not made in accordance with the conditions set forth herein. Please note Sotheby’s reserves the right to refuse to accept payment from a source other than the buyer of record. All collections and deliveries for purchased property will be handled by GA in coordination with purchasers after the auction. Unless otherwise agreed by GA, all property must be removed from GA’s or GA’s vendor’s premises (as indicated on the invoice) by the purchaser at his expense not later than 30 calendar days following the close of the auction. Purchasers are reminded that GA’s liability for loss of or damage to sold property shall cease upon the earlier of (a) 30 calendar days after the close of the auction and (b) GA’s release of the property to the purchaser or the purchaser’s designated agent. Upon the expiration of such 30 calendar day period or upon such earlier release, as applicable: (i) the purchaser bears full liability for any and all loss of or damage to the property; (ii) the purchaser releases Sotheby’s, GA, its and their affiliates, agents and warehouses from any and all liability and claims for loss of or damage to the property; and (iii) the purchaser agrees to indemnify and hold Sotheby’s, GA, its and their affiliates, agents and warehouses harmless from and against any and all liability for loss of or damage to property and any all claims related to loss of or damage to the property as of and from and after the time GA’s liability for loss or damage to the property ceases in accordance with this paragraph. If any applicable conditions herein are not complied with by the purchaser, the purchaser will be in default and in addition to any and all other remedies available to us, GA and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the total purchase price, including all fees, charges and expenses more fully set forth herein, we, at our option, may (w) sell the applicable lot or lots to the underbidder, (x) cancel the sale of that, or any other lot or lots sold to the defaulting purchaser at the same or any other auction, retaining as liquidated damages all payments made by the purchaser, or (y) resell the purchased property, whether at public auction or by private sale, or (z) effect any combination thereof. In any case, the purchaser will be liable for any deficiency, any and all costs, handling charges, late charges, expenses of both sales, our commissions on both sales at our regular rates, legal fees and expenses, collection fees and incidental damages. Payment will not be deemed to have been made in full until we have collected good funds. Any claims relating to any purchase, including any claims under the Conditions of Sale or GA Authenticity and Returns Policy, must be presented directly to GA. In the event the purchaser fails to pay any or all of the total purchase price for any lot and GA nonetheless elects to pay the Consignor any portion of the sale proceeds, the purchaser acknowledges that GA shall have all of the rights of the Consignor to pursue the purchaser for any amounts paid to the Consignor, whether at law, in equity, or under these Conditions of Sale.
11. Payment Invoices will be emailed by Sotheby’s to successful bidders within one day after the close of the auction. All invoices must be paid in full within 10 days of the close of the auction. Sotheby’s will share successful bidder information with GA, and GA will separately email an invoice to successful bidders for any shipping charges. Please see Section 16 for additional information regarding shipping.
12. Reserve Unless otherwise indicated, all lots in this catalogue are offered subject to a reserve, which is the confidential minimum hammer price at which a lot will be sold. No reserve will exceed the low presale estimate stated in the catalogue, or as amended by notices posted on the Sotheby's website.
13. Tax Unless exempted by law, the purchaser will be required to pay the combined New York State and local sales tax, any applicable compensating use tax of another state, and if applicable, any federal luxury or other tax, on the total purchase price. The rate of such combined tax is 8.875% in New York City and ranges from 7% to 8.625% elsewhere in New York.
14. Export and Permits It is the purchaser’s sole responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any notices in the sale catalogue reflect Sotheby’s reasonable opinion at the time of cataloguing and are for bidders’ general guidance only; Sotheby’s and the Consignor make no representations or warranties as to whether any lot is or is not subject to export or import restrictions or any embargoes.
15. Governing Law and Jurisdiction These Conditions of Sale and Terms of Guarantee, as well as bidders’, the purchaser’s and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of New York. By bidding at an auction, all bidders including the purchaser, shall be deemed to have consented to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of New York. All parties agree, however, that Sotheby’s shall retain the right to bring proceedings in a court other than the state and federal courts sitting in the State of New York.
16. Packing and Shipping Neither GA nor GA’s vendors are responsible for the acts or omissions in GA’s or GA’s vendors’ packing or shipping of purchased lots or of other carriers or packers of purchased lots, whether or not recommended by GA. Packing and handling of purchased lots is at the entire risk of the purchaser.
17. Limitation of Liability In no event will the aggregate liability of Sotheby’s, GA and the consignor to a purchaser exceed the purchase price actually paid. Sotheby’s and GA shall have no liability for any claims made by the underbidder or any bidder who is not the winning bidder of a particular lot(s). Sotheby's and GA will not be responsible for any errors or failures to execute bids placed online or for any errors or omissions in connection therewith including, without limitation, errors or failures caused by (i) a loss of connection to the internet or the Sotheby's online platform software by either Sotheby's or the client; (ii) a breakdown or problem with Sotheby's online platform software; or (iii) a breakdown or problem with a client's Internet connection, mobile network or computer.
18. Data Protection Sotheby’s will hold and process your personal information and may share it with its subsidiaries and affiliates for use as described in, and in line with, Sotheby’s Privacy Policy published on Sotheby’s website at www.sothebys.com or available on request by email to enquiries@sothebys.com. Under European data protection laws, a client may object, by request and free of charge, to the processing of their information for certain purposes, including direct marketing, and may access and rectify personal data relating to them and may obtain more information about Sotheby’s data protection policies by writing to Sotheby’s, 34-35 New Bond Street, London W1A 2AA, or 1334 York Avenue, New York, NY 10021, Attn: Compliance, or emailing enquiries@sothebys.com. Online bids may be recorded. You acknowledge and agree that Sotheby’s will share information on winning bidders with GA in accordance with the terms of these Conditions of Sale.
19. Cancellation Right
The Consumer Rights Directive (Directive 2011/83/EU) and related regulations implemented by the European Union (“EU”) member states and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (as amended) (the “Regulations”) give bidders who are consumers and are habitually resident within an EU member state or the United Kingdom (an “EU/UK Bidder”) who purchase goods and services online or otherwise “at a distance” certain cancellation rights under the Regulations.
Under the Regulations, an EU/UK Bidder who purchases property during the sale from a seller that is a trader has the right to cancel the contract (provided that such contract is a distance contract or an off-premises contract for the purposes of the Regulations) for any reason and without incurring liability within a period of fourteen days after the day on which the property comes into the physical possession of either the EU/UK Bidder or a person identified by the EU/UK Bidder to take possession of the property (but not the carrier of the property) (the “Goods Cancellation Period”).
Under the Regulations, in connection with the purchase of property from a seller that is not a trader, an EU/UK Bidder who purchases shipping services from Sotheby’s (the “Shipping Services”) has the right to cancel the Shipping Services for any reason within a period of fourteen days after the date on which the contract to provide the Shipping Services is concluded (the “Services Cancellation Period”) unless where at the EU/UK Bidder’s express request it has been agreed that the Shipping Services will begin during the Services Cancellation Period. In the case that the Shipping Services have begun prior to the expiry of the Services Cancellation Period, the EU/UK Bidder will have the right to cancel the Shipping Services during the Services Cancellation Period until the Shipping Services have been fully performed after which point the cancellation right will no longer apply. If the EU/UK Bidder lawfully cancels the contract for Shipping Services, Sotheby’s will reimburse the EU/UK Bidder all payments received from the EU/UK Bidder in relation to the Shipping Services provided always that if the EU/UK Bidder requested Sotheby’s to begin the performance of the Shipping Services during the Services Cancellation Period, the EU/UK Bidder will remain liable for Sotheby’s reasonable costs.
To exercise the right to cancel, the EU/UK Bidder must inform Sotheby’s, Inc. at: Post Sale Services, 1334 York Avenue, New York, NY 10021; telephone: +1 212 606 7444; fax: +1 212 606 7043; uspostsaleservices@sothebys.com; of its decision to cancel the contract for the purchase of property and/or for the provision of Shipping Services (as applicable) by a clear statement (e.g. a letter sent by post, fax or email) or using the model cancellation form, a copy of which can be obtained from Sotheby’s, Inc. at the address noted above. In order to meet the applicable cancellation deadline, the EU/UK Bidder is required to send his/her communication concerning the exercise of the cancellation right (i) in relation to a purchase of property before the Goods Cancellation Period has expired and (ii) in relation to the provision of Shipping Services before the Services Cancellation Period has expired. In connection with any cancellation, Sotheby’s may require that you furnish us, upon our request, with any additional information necessary for Sotheby’s to assess whether in our reasonable opinion you would be deemed a trader under the Regulations.
If you cancel the contract for the purchase of property within the applicable Goods Cancellation Period, Sotheby’s, Inc. will reimburse you all payments received from you, including the costs of delivery but not any extra costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us; or any import duties we incur as a result of you returning the property to us. Sotheby’s, Inc. is entitled to deduct from the reimbursement the amount of any loss in value of property which is caused as a result of unnecessary handling by you. Sotheby’s, Inc. will make the reimbursement without undue delay, and not later than (i) 14 calendar days after the date on which we receive back from you any property supplied; or (ii) (if earlier) 14 calendar days after the date on which you provide evidence that you have returned the property. Sotheby’s, Inc. will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. Sotheby’s, Inc. may withhold reimbursement until we have received the property back or you have supplied evidence of having sent back the property, whichever is earliest. You must send back the property or return them to us at such address as we may specify for the purpose, without undue delay and in any event not later than 14 calendar days from the date after the date on which you communicate your cancellation to us. The deadline is met if you send back the property before the period of 14 calendar days has expired. You will have to bear the costs of returning the property. If Sotheby’s, Inc. arranged for the property to be delivered, we estimate that the cost of returning the property by the same means is likely to be similar to the cost of delivery. You are only liable for any diminished value of the property resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the lot. If you cancel the contract for the supply of Shipping Services within the applicable Services Cancellation Period, we will reimburse to you any payments received from you in respect of the service. However, if you have requested us to begin the performance of services during the Services Cancellation Period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.
GA AUTHENTICITY AND RETURNS POLICY
(A) Trading cards, Game Tickets (any items encapsulated by a Third Party Grading (TPG) Company): There are no returns on graded and/or authenticated cards, game tickets or any items encapsulated by a TPG (items). The graded "items" in our auction will almost exclusively be graded by the three leading and most respected card grading and authentication companies, PSA, SGC and Beckett (BVG/BGS). We do not guarantee any "items" graded by a specific company will receive the same grade by a competing grading company. Any trading card, card related item or "items" that is not graded is viewable on our website, in person, and through detailed descriptions. Please review this before bidding as there are no returns unless an ungraded "item/s" has an error in description. Any grades given on "items" NOT graded and in slabs are internal estimates of grades and are not guaranteed to receive those grades by a TPG, nor is a difference of opinion on those grades considered an 'error in description.'
(B) Autographed items: If an item is not first party authenticated (such as Major League Baseball) we will offer items certified by PSA/DNA, Beckett, JSA and University Archives authenticated from consignors. Whenever possible, especially for modern items, we try to get first person authenticators such as MLB authentication, the athlete themselves, or well known companies that contract with the athlete and witness each autograph. Returns on autographed items are accepted within 30 days of close of auction on items that are NOT certified by either PSA/DNA, JSA, Beckett, University Archives, MLB Auth or first party authenticated items (Steiner, UDA, Mounted Memories, Tri Star, Lojo etc) ONLY if such item does not pass authentication of PSA/DNA and we are provided with such written notice within 30 days of purchase. Items purchased with a PSA/DNA, JSA LOA, Beckett LOA as well as items which have been 'pre authenticated' by PSA/DNA or Beckett or comes with an 'auction letter' from JSA, or certified by MLB, UDA, Steiner,Tri Star, Lojo, or player controlled hologram such as Nolan Ryan, Joe Namath, Barry Bonds and Joe Montana etc are non refundable. We use PSA, JSA and Beckett for our internal autograph authenticators and will use them both based on the high volume of autographs we receive and the man hours required to review items in our auctions. We do not guarantee that all companies that certify autographs will agree with each other's opinion and a certified autograph by PSA JSA or Beckett may not be returned due to a competing firm disagreeing with their evaluation.
Please note some autographed items come with a COA or LOA, others come only with hologram or sticker.
(C) Game Used items: We strive to offer product that is direct from an athlete, team, or league and comes with their certification as to game use. There are no returns on items that come with a letter of authentication from an athlete, team or league stating an item was used by a player, even if the player is not the person writing the letter of authentication. For other products, we use a variety of Third Party Authenticators such as MeiGray, MEARS, Sports Investors, 100% Authentic, Resolution Photo matching and several others. All items that come with documentation of game use, or have been authenticated, returns are NOT permitted regardless of a difference of opinion from a different authenticator. Lots that comes with a Lots that are NOT listed or described as 'photomatched' cannot be returned if the winning bidder fails to obtain a photomatch after receiving the item. All game used items are sold as described by the accompanying authentication (as is).
(i) BOXING Fight Used items: All Boxing fight used items will come with a letter from the boxer, trainer, manager, or third party authenticators Craig Hamilton (JO Sports Inc) and WBC Authenticated. No returns will be allowed on boxing fight used items that come with any or all of the above authentication.
(D) Framed items: While we make every effort to protect the frames included in these lots during the auction while the item is in our possession and during shipping, we cannot be responsible for damage to framed items that may occur. If something was damaged in shipping GA will help you with any claim with the shipping company. Framed items are NON returnable due to frame damage, please keep this in mind when bidding on a 'framed item'. You are welcome to request a frame be removed from your item prior to shipping if you are the winning bidder. There will be NO EXCEPTIONS to this policy.
(E) High Resolution Photographs and double zoom: Please note that we post multiple high resolution photographs for each lot. It is the sole responsibility of the bidder to carefully inspect each lot photo prior to bidding on a particular lot. Any wear, damage, etc., will be fully visible in the photographs and no returns or refunds will be allowed regardless of whether the damage and/or wear is mentioned in the lot description.
(F) 3rd Party Authenticators Database Information: Please note that recently authenticated items by 3rd party authenticators (including but not limited to: PSA/DNA, JSA, SGC, Steiner, Fanatics, Mears and Meigray) serial numbers and/or hologram numbers may not appear in their database for some time as the authentication information may not be entered immediately by the 3rd party authenticators. GA is in no way responsible for any delay/s involving the 3rd party authenticators entering of authentication information nor is the aforementioned delay sufficient cause to cancel a winning bid and/or refusal to pay any amounts due to GA.
Except as listed above, all sales are final with no returns permitted.
2. During the Auction
The Catalogue The catalogue will be available online at the start of the auction and is available throughout the auction.
Estimates Each lot in the catalogue is given a low and high estimate, indicating to a prospective buyer a range in which the lot might sell at auction. When possible, the estimate is based on previous auction records of comparable pieces. The estimates are often determined several months before a sale and are therefore subject to change upon further research of the property, or to reflect market conditions or currency fluctuations. Estimates should not be relied upon as a representation or prediction of actual selling prices.
Notices Notices amend the catalogue description of a lot after our catalogue has been published on the Sotheby's website. Please take note of them.
Bidding If you would like to bid, you must have a Sotheby's online account. Sotheby's reserves the right, in our sole discretion, to refuse your registration or participation in the auction or to revoke your permission to participate before, during or after the sale.
All lots sold will be invoiced by Sotheby’s to the name and address registered for the bid and cannot be transferred to other names and addresses. Sotheby’s reserves the right to refuse to accept payment from a source other than the buyer of record. For information about registering to bid please visit the Sotheby's website.
Employee Bidding Sotheby’s employees may bid in a Sotheby’s auction only if the employee does not know the reserve and if the employee fully complies with Sotheby’s internal rules governing employee bidding.
US Economic Sanctions The United States maintains economic and trade sanctions against targeted foreign countries, groups and organizations. There may be restrictions on the import into the United States of certain items originating in sanctioned countries, including Cuba, Iran, North Korea and Sudan. The purchaser’s inability to import any item into the US or any other country as a result of these or other restrictions shall not justify cancellation or rescission of the sale or any delay in payment.
Hammer Price and the Buyer’s Premium and Overhead Premium For lots which are sold, the last price for a lot noted by the Sotheby's online bidding system is the hammer price. A buyer’s premium and overhead premium will be added to the hammer price and is payable by the purchaser as part of the total purchase price. The buyer’s premium and overhead premium will be the amount stated in the Sotheby’s Conditions of Sale.
3. After the Auction
Payment If your bid is successful, your invoice will be e-mailed to you. The final price is determined by adding the buyer’s premium, overhead premium and any other applicable charges to the hammer price on a per-lot basis. Sales tax, where applicable, will be charged on the entire amount. Payment is due in full immediately after the sale. However, under certain circumstances, Sotheby’s may, in its sole discretion, offer bidders an extended payment plan. Such a payment plan may provide an economic benefit to the bidder. Credit terms should be requested at least one business day before the sale. However, there is no assurance that an extended payment plan will be offered. Please contact Post Sale Services or the specialist in charge of the sale for information on credit arrangements for a particular lot. Please note that Sotheby’s will not accept payments for purchased lots from any party other than the purchaser, unless otherwise agreed between the purchaser and Sotheby’s prior to the sale. Please note that your Sotheby’s invoice will not include any charges for shipping, which will be contained in a separate invoice provided to you by GA. You will pay GA directly for any shipping or related charges contained in the GA invoice.
Payment by Cash It is against Sotheby’s general policy to accept payments in the form of cash or cash equivalents.

Payment by Wire Transfer To pay for a purchase by wire transfer, please refer to the payment instructions on the invoice provided by Sotheby’s or contact Post Sale Services to request instructions.
Sales and Use Tax New York sales tax is charged on the hammer price, buyer's premium, overhead premium and any other applicable charges on any property picked up or delivered in New York State, regardless of the state or country in which the purchaser resides or does business. Purchasers who wish to use their own shipper who is not a considered a “common carrier” by the New York Department of Taxation and Finance will be charged New York sales tax on the entire charge regardless of the destination of the property. Please refer to “Information on Sales and Use Tax Related to Purchases at Auction” in the back of the catalogue.
Collection and Delivery
Costs for packaging, shipping and insurance will be provided to successful bidders in an invoice provided by GA. No lots will be shipped until full payment is received. All invoices greater than $1000.00 must be shipped via FedEx or UPS to a physical address with an adult signature requirement for insurance purposes. Items will be shipped as soon as possible after the payment has cleared. If you would like to pick your items up in person at GA’s New Jersey location, GA will waive the shipping and handling charges, however sales tax will be charged in accordance with New Jersey tax codes. Most items are sent FedEx with tracking, insurance, and signature confirmation. However, orders shipped internationally will be shipped via UPS. Extremely large or heavy items may require special shipping arrangements. If you are interested in bidding on an oversized item, we suggest calling GA before bidding to determine the approximate shipping cost. All shipments are covered by our fine arts insurance policy, calculated and charged at $0.90 per $100 of price realized. All packages shipped on our FedEx/UPS/USPS accounts are covered under GA’s fine arts insurance. If you wish to ship via USPS you will need to contact GA’s office for special arrangements. Exceptions may be made for domestic shipments valued at less than $1,000 with a valid waiver, however no exceptions will be made for international shipments.
GA accepts winning bidder payments for shipping by personal check, certified check, cashier’s check, bank check, money order, and wire transfer. Please note that wire transfers less than $1,000.00 will be subject to a $15.00 processing fee. Other acceptable methods of payment include Visa, Master Card, American Express, and Discover for invoices under $7500. Special arrangements can be made prior to auction close to accept credit card charges in excess of $7,500.00. GA does not accept Paypal. Shipping for orders paid by personal checks will be held for 5 business days. If a shipping invoice has not been paid within 15 days of invoice date, the bidder's credit card on file will be automatically charged for the full amount due on the 15th day from the date of the auction close. GA reserves the right to charge interest on past due unpaid balances at 1.5% per month until paid.
The Art Loss Register As part of Sotheby’s efforts to support only the legitimate art market and to combat the illegitimate market in stolen property, Sotheby’s has retained the Art Loss Register to check all uniquely identifiable items offered for sale in this catalogue that are estimated at more than the equivalent of US$1,500 against the Art Loss Register’s computerized database of objects reported as stolen or lost. The Art Loss Register is pleased to provide purchasers with a certificate confirming that a search has been made. Why Sotheby’s Collects Sales Tax Virtually all State Sales Tax Laws require a corporation to register with the State’s Tax Authorities and collect and remit sales tax if the corporation either establishes or maintains a physical or economic presence within the state. In the states that impose sales tax, Tax Laws require an auction house, with such presence in the state, to register as a sales tax collector, and remit sales tax collected to the state. New York sales tax is charged on the hammer price, buyer's premium, overhead premium and any other applicable charges on any property picked up or delivered in New York, regardless of the state or country in which the purchaser resides or does business.
Where Sotheby’s Collects Sales Tax Sotheby’s is currently registered to collect sales tax in the following states: Alabama, Arizona, Arkansas, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Vermont, Virginia, Washington, Wisconsin and Wyoming. For any property collected or received by the purchaser in New York City, such property is subject to sales tax at the existing New York State and City rate of 8.875%.
Where Sotheby’s is Not Required to Collect Sales Tax Sotheby’s is not required to collect sales tax on property delivered to states other than those listed above. If the property is delivered to a state where Sotheby’s is not required to collect sales tax, it is the responsibility of the purchaser to self-assess any sales or use tax and remit it to taxing authorities in that state.
Sotheby’s is not required to collect sales tax for property delivered to the purchaser outside of the United States.
Restoration and Other Services Regardless of where the property is subsequently transported, if any framing or restoration services are performed on the property in New York, it is considered to be a delivery of the property to the purchaser in New York, and Sotheby’s will be required to collect the 8.875% New York sales tax.
Certain Exemptions Most states that impose sales taxes allow for specified exemptions to the tax. For example, a registered re-seller such as a registered art dealer may purchase without incurring a tax liability, and Sotheby’s is not required to collect sales tax from such re-seller. The art dealer, when re-selling the property, may be required to charge sales tax to its client, or the client may be required to self-assess sales or use tax upon acquiring the property.
Local Tax Advisors As sales tax laws vary from state to state, Sotheby’s recommends that clients with questions regarding the application of sales or use taxes to property purchased at auction seek tax advice from their local tax advisors.
