Conditions of Business for Buyers (English)

Additional conditions applicable to Lot 694, Richard Long, Georgia Granite Line; Lot 695, Mimmo Paladino, Untitled; Lot 696, Not Vital, Big Tongue; Lot 697, Marc Quinn, Archaeology of Desire: These lots are being offered for sale in situ from their current location in California and are not at Sotheby’s York Avenue location. The Buyer of these lots shall be responsible for relocating them from their current location, including obtaining the necessary insurance to do so and covering all associated costs and fees. Prospective buyers should contact ctpdaysale@sothebys.com with inquiries.

After Sotheby’s receipt of the full purchase price in cleared funds, the Buyer is obligated to arrange collection of the purchased lot, which collection must occur no later than 90 days after the sale unless otherwise agreed in writing between Sotheby’s and the Buyer. Risk of loss for any loss or damage and title to the lot shall transfer to the Buyer upon the Buyer’s collection of the lot. Prior to such time, in the event the lot incurs any loss or damage so that it is not in the substantially the same state as stated in the condition report for the lot, Sotheby’s will refund the Buyer any amounts paid for the lot, unless otherwise agreed by the Buyer, the consignor and Sotheby’s. A condition report for the lot is available upon request.

If the Buyer fails to timely relocate the lot within 90 days of the auction other than for reasons beyond the Buyer’s control, Sotheby’s may rescind the sale subject to a fee of 20% of the Hammer Price charged to Buyer by Sotheby’s and the consignor.

Additional conditions applicable to Lot 714, George Rickey, Two Lines Oblique Gyrator): This lot is being offered for sale in situ from its current location in a New York warehouse of a reputable agent and is not at Sotheby’s York Avenue location. The Buyer of the lot shall be responsible for relocating it from its current location, including obtaining the necessary insurance to do so and covering all associated costs and fees. The Buyer of the lot shall be responsible for relocating it from its current location, including obtaining the necessary insurance to do so and covering all associated costs and fees.
